The court of appeal in Abuja has refused to set aside its own judgment which affirmed the declaration of Jarigbe Agom as the duly elected candidate of the Peoples Democratic Party (PDP) for the Cross River North Senatorial bye-election.
The panel of five-man justices led by the president of the court of appeal, Justice Monica Dongban – Mensem held that the court does not have the power to set aside its own decisions except there are statutory rules to do so, and the appeal the judges say, is a gross abuse of court process.
